Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Catchfolio websites, apps, APIs, and related products and features (the “Service”) operated by Catchfolio from New Zealand (“Catchfolio”, “we”, “us”) at catchfol.io. By creating an account, signing in, or using the Service, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date above. If we make material changes, we will try to give at least 30 days' notice where practicable (for example by posting a notice in the Service or emailing an address associated with your account). Continued use of the Service after the revised Terms take effect means you accept them. If you do not agree, stop using the Service and delete your account.

Catchfolio is an independent, unofficial collection tool for trading-card collectors. It may let you scan and identify cards, track ownership and value, build digital binders, review market information, record sales and pack openings, create 3D card renders, and optionally share selected content. We may add, change, limit, or remove features. Catchfolio is not a bank, broker, grading company, insurer, payment processor, or marketplace settlement service.

We may set reasonable usage limits (for example scan volume or API rate limits) to keep the Service stable and fair. Where practicable we will give notice of new hard limits.

Catchfolio is not affiliated with, endorsed, sponsored, approved, or authorized by any trading-card game publisher, licensor, or rights holder, including without limitation Nintendo, Creatures Inc., GAME FREAK inc., The Pokémon Company, The Pokémon Company International, Wizards of the Coast, Konami, Bandai, Disney, or any related owners (together, the “Rights Holders”).

Pokémon and other TCG names, logos, character names, set names, card names, trade dress, and artwork are trademarks, copyrights, or other intellectual property of their respective Rights Holders (including © Nintendo / Creatures Inc. / GAME FREAK inc. / The Pokémon Company / The Pokémon Company International). Catchfolio does not own and does not claim ownership of those materials. References appear only for collection identification, cataloguing, and portfolio tracking.

The Catchfolio name, branding, site design, software, documentation, and original Catchfolio materials are owned by Catchfolio or its licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal collection management. Except where mandatory law allows, you may not copy, scrape at scale, mirror, reverse engineer, resell, or commercially exploit the Service or its non-public data feeds without our prior written consent.

We may use aggregated, anonymised, or de-identified usage and diagnostic data to operate, secure, and improve the Service and related products. That data will not identify you.

You must be at least 13 years old (or the higher minimum age required in your country) and able to form a binding contract. If you use the Service for an organisation, you confirm you have authority to bind it.

You must provide accurate registration information and keep it updated. You are responsible for activity under your account and for keeping credentials secure. Notify us promptly of unauthorised access. You may not create an account for someone else without their permission, buy/sell accounts, or share login credentials. We may change usernames that infringe rights or impersonate others, and may refuse, suspend, or terminate accounts that create security, legal, or abuse risks.

Some features ask for camera or gallery access so you can photograph or upload trading cards for identification, centering tools, binder covers, or 3D renders. Images are processed to provide those features. You are responsible for image quality and for not using scanning or upload features to infringe third-party rights (including unauthorised mass reproduction or distribution of copyrighted card art beyond ordinary personal collection use).

We do not sell your scanned or uploaded card images. We may store them as needed to run your account features, and may process them on our servers or processors solely to provide the Service, as described in the Privacy Policy. We may modify or discontinue scanning features at any time.

You retain ownership of content you upload (photos, notes, binder customisations, and similar), subject to third-party rights in any depicted material. You are solely responsible for that content and for ensuring you have the rights needed to upload and share it.

You grant Catchfolio a worldwide, non-exclusive licence to host, store, process, transcode, resize, back up, and display your content solely as needed to operate the Service and any sharing features you enable. Public share links make the shared material reachable by anyone with the link until the share expires or is removed. The licence ends when the content is deleted from our systems, except for reasonable backup, legal, or security retention described in the Privacy Policy.

We may remove or disable content that appears unlawful, infringing, abusive, or harmful, and may cooperate with law enforcement or court orders where required. We do not undertake to monitor all user content and are not liable for content posted by users, subject to applicable law.

You agree not to:

• upload unlawful, infringing, deceptive, exploitative, or harmful material;
• harass, threaten, defame, or impersonate others, or Catchfolio;
• attempt to access another person's account or non-public systems;
• interfere with, overload, probe, crawl, or disrupt the Service;
• evade rate limits, security controls, or usage caps;
• scrape, harvest, or bulk-export catalog, price, or user data beyond ordinary personal use of the product interfaces;
• transmit malware, spam, or automated account creation without permission;
• misuse third-party marketplaces, APIs, or login providers;
• sell, license, or transfer accounts or harvested Service data; or
• use the Service to provide competing bulk data products without permission.

Card identification, centering or condition estimates, market prices, portfolio values, trade suggestions, and marketplace research are automated or aggregated estimates. They may be incomplete, delayed, or wrong. They are for personal collection management only and are not financial, investment, appraisal, grading, tax, or purchasing advice. Always verify important decisions against physical cards and independent sources. Your use of identification and pricing outputs is at your own risk.

The Service may link to or rely on third parties (for example social login providers or external marketplaces). Those services are governed by their own terms and privacy policies. Catchfolio is not responsible for third-party sites, availability, content, or security.

We aim for reliable uptime but do not guarantee uninterrupted, secure, or error-free Service. Features may change, be interrupted, or be withdrawn without liability to you, except where liability cannot be excluded by law.

You may stop using the Service and delete your account at any time from Profile. See the data deletion instructions. After a valid deletion request, we begin removing account data from active systems as soon as practicable (typically within 30 days). Residual copies may remain in backups or disaster-recovery systems for a limited period (typically up to about 90 days) before they rotate out, except where we must retain limited records for legal, security, or dispute reasons.

We may suspend or terminate access for breach of these Terms, repeated infringement, legal risk, or to protect the Service or users. Where practicable we will notify you. Provisions that by nature should survive (including intellectual property, your content licence for residual copies, disclaimers, limitation of liability, indemnity, and governing law) survive termination.

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that identification, prices, portfolio figures, or other outputs are accurate, complete, or suitable for any decision, or that the Service will be free of errors, viruses, or interruptions.

To the fullest extent permitted by law, Catchfolio and its operators, officers, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for losses arising from reliance on identification, grading, pricing, portfolio information, or other Service outputs (including from poor image quality or device camera issues), even if advised of the possibility. Our aggregate liability arising out of or relating to the Service will not exceed NZ$100 or the amount you paid us for the Service in the 12 months before the claim, whichever is greater. Nothing in these Terms limits liability that cannot be limited under applicable law (including New Zealand consumer guarantees that cannot be excluded).

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Catchfolio and its operators, officers, and service providers from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your misuse of the Service, your breach of these Terms, or your infringement of third-party rights.

These Terms are governed by the laws of New Zealand. Subject to mandatory consumer protections where you live, the courts of New Zealand have non-exclusive jurisdiction over disputes arising from these Terms or the Service. These Terms do not limit rights you may have under mandatory consumer protection law.

If a provision is unenforceable, the remainder stays in effect. These Terms and the Privacy Policy are the entire agreement between you and Catchfolio regarding the Service and supersede prior understandings on that subject. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or sale of assets. Notices may be provided via the Service or the email associated with your account.
